Raping the Shariah

Salaam and Greetings of Peace:

Isla has a story on her blog entitled Raping the Shariah, about Mukhtaran Mai and her gang-rape for the sake of “honor.”  This barbaric tribal custom has nothing to do with Islam, yet that is how it is perceived by the outside world. Honor rapes and killings! stoning women in Iran!  The Muslim world does not have to worry about being conquered by the West. They are defeating themselves as long as such cruel, stupid, barbarous patriarchal customs are allowed to continue unchallenged.

    Asalaamu alaikum.

    Just wanted to let you know the quote you attribute to Mary Crow Dog is not her own. It is a very very old Cheyenne proverb. Many of us quote it, and I am familiar with Mary (I have that book!) too but none of us would dare to take the credit for it.

    the shariah at its current form even has a lot of contradiction with Quran itself.

    it is quite sad, but true.

    there are muslim law on divorce which says, if a husband pronounce divorce 3 times, the divorce is valid. whereas in Quran it is very explicitely said, divorce has to be with witness.

    in countries like pakistan, bangaldesh or india worse in arabic countries, abuse in the name of shariah is what really absue the religion.

    also the shariah ruling on rape of woman is a true disgrace. shariah demand there should be 3 witness for a rape victim woman to prove. who invented such thing? M. Asad, the famous jewish converted Muslim commented in his Quran translation that only a mad person can ask or created such law.

    it has nothing to do with islam, but rather they are information terrorism inside Islam itself.

    I never understood the reasoning for 3 witnesses, but then 9 or 12 members of a jury is an arbitrary number as well. But with the advent of modern forensics, it doesn’t really matter anymore since you don’t need an eye witness to an actual crime to prove guilt.

    It occurs to me that if these countries really wanted to remain true to the spirit of Sharia, they would incorporate this modern technology. For example, if a woman reported a rape and was taken to a hospital or medical clinic as she *should* be, and a DNA sample were taken, it could be analyzed by 3 seperate individuals, which might not be a bad idea since individuals do make mistakes. The same with forensic evidence for murder and assault.

    It really would not be hard, if people really decided to take this issue seriously.

    And yeah, Mukhtaran Mai rocks! When I think of her, I think of Sojourner Truth…

    MaShaAllaah from all I know Mukhtaran Mai has done some great things since the crime against her occurred — May Allaah (swt) continue to strengthen and reward her.

    What was done to her was not done in the name of Islam but in the name of Tribal Law (Jahilliyah). It was the explicit result of people who place other laws above the Shariah not of people trying to follow Shariah.

    I don’t really understand Sadiq’s points, but they seem misplaced — differences in interpretation of certain Shari’ah rulings are one issue, but they are not what is at issue here.

    The solution to such Jahilliyah is Islam, Islaam is made to destroy Jahilliyah (Ignorance).
